1. Acceptance and Binding Agreement

By accessing or using DreamScape's services ("Services"), you enter into a legally binding agreement with DreamScape ("we," "us," or "our"). If you do not agree to these terms, you must immediately discontinue use of our Services. These Terms of Service ("Terms") constitute the entire agreement between you and DreamScape regarding your use of the Services, superseding any prior agreements.

2. Service Description and Limitations

DreamScape provides dream interpretation and analysis services through artificial intelligence and other technological means. You acknowledge and agree that: (a) our Services are for entertainment and self-reflection purposes only; (b) we do not provide medical, psychological, or professional advice; (c) any decisions made based on information provided through our Services are solely your responsibility; and (d) we reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice or liability.

3. Artificial Intelligence and Technology

Regarding our use of artificial intelligence and related technologies:

• You acknowledge that our Services utilize AI models that may produce varying, inconsistent, or unexpected results
• We make no guarantees about the accuracy, reliability, or appropriateness of AI-generated content
• You understand that AI technology is evolving and may have inherent limitations or biases
• We are not liable for any decisions, actions, or consequences resulting from AI-generated interpretations
• You agree not to use our Services for any critical decisions affecting health, safety, or financial matters

4. Data Protection and Security

Regarding your data and our security measures:

• We implement reasonable security measures to protect your data, but no method of transmission or storage is 100% secure
• You acknowledge that any data you provide may be processed by AI systems and stored on secure servers
• In the event of a data breach, we will notify affected users as required by applicable laws
• We are not liable for any unauthorized access, data loss, or breach that occurs despite our reasonable security measures
• You are responsible for maintaining the security of your account credentials
• We may use anonymized data for improving our AI models and Services
• We will not sell or share your personal data with third parties without your consent, except as required by law

5. User Accounts and Security

By creating and maintaining an account, you:

• Warrant that all information provided is accurate, complete, and current
• Are solely responsible for maintaining the confidentiality of your account credentials
• Accept full responsibility for all activities occurring under your account
• Must immediately notify us of any unauthorized access or security breaches
• Acknowledge that we may terminate your account for any violations of these Terms

6. Auto-Renewable Subscriptions

DreamScape offers the following auto-renewable subscription options:

• DreamScape Premium Monthly: $9.99/month, automatically renews each month
• DreamScape Premium Annual: $99.99/year ($8.33/month), automatically renews yearly

Important Subscription Terms:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
• Account will be charged for renewal within 24-hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store
• Any unused portion of a free trial period will be forfeited when purchasing a subscription
• Prices are subject to change with notice to subscribers
• No refunds will be provided for any unused portion of a subscription period

7. User Content and Rights

Regarding content submitted to our Services:

• You retain ownership of your content
• You grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your content for the purpose of operating and improving our Services
• You represent and warrant that you have all necessary rights to grant this license
• We may remove any content at our sole discretion without notice
• You are solely responsible for backing up your content

8. Prohibited Activities

You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Interfere with or disrupt the Services or servers
• Attempt to gain unauthorized access to any part of the Services
• Use the Services for any illegal or harmful purposes
• Reverse engineer or decompile any aspect of the Services
• Scrape or collect data from the Services without authorization
• Upload malicious code or content
• Impersonate others or provide false information

9. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of DreamScape or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Any unauthorized use of our intellectual property may result in legal action.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, NON-INFRINGEMENT, AND ACCURACY. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS, OR BE ACCURATE, RELIABLE, COMPLETE, LEGAL, OR SAFE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DREAMSCAPE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. IN JURISDICTIONS WHERE LIMITATIONS OF LIABILITY ARE NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless DreamScape and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.

13. Dispute Resolution

Any dispute arising from these Terms or the Services shall be governed by the laws of Quebec, Canada, without regard to conflict of law principles. You agree that any legal action or proceeding between you and DreamScape shall be brought exclusively in the federal or provincial courts located in Quebec, Canada, and you hereby accept and submit to the personal jurisdiction of these courts with respect to any legal actions, suits, or proceedings arising out of these Terms or your use of the Services.

14. Force Majeure and Technical Issues

DreamScape shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of nature, war, terrorism, pandemic, changes in law or regulations, AI model limitations, technical malfunctions, server issues, data breaches by third parties, or other technological disruptions. We will make reasonable efforts to maintain service availability and data security but cannot guarantee uninterrupted access or absolute security.

15. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. We will notify users of any material changes via email or through our Services. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
